ACNUR insta a los Estados a receptores de esta migración a permitir “el acceso a su territorio y a que continúen adoptando respuestas adecuadas y pragmáticas orientadas a la protección”, que permita a esta población una estancia legal por medio de visados o mecanismos migratorios laborales. Se sugiere a los Estados el cumplimiento de unos estándares mínimos para la aplicación de estos mecanismos, con el fin de que sean efectivos y se apeguen a las disposiciones del derecho internacional de los derechos humanos, del estatuto de los refugiados de 1951 y de la declaración de Cartagena. Estos estándares mínimos deben garantizar:
- Legalidad (documento oficial reconocido por la autoridades. Ejemplo: PEP)
- Accesibilidad (Sin costo, de fácil tramite, y sin importar la fecha de ingreso al país)
- Acceso a derechos básicos (salud, educación, trabajo, unidad familiar, libertad de circulación y acceso a albergue)
- Garantías de no retorno (garantía de no deportación o expulsión para los beneficiarios de las medidas de protección)
Todo lo anterior sin perjuicio del derecho a solicitar asilo.
Por último ACNUR hace un llamado para que los Estados tomen medidas tendientes a combatir el racismo, la xenofobia y la discriminación que pueden comprometer la seguridad e integridad de los venezolanos.
